Privacy Policy

This is Energine's Personal Data Processing Policy. It explains what data we collect through energine.co, why we use it and how you can exercise your rights. For data subjects in Colombia, it is issued under Law 1581 of 2012 and Decree 1074 of 2015 (which compiles Decree 1377 of 2013).

1. Data controllers

The site is operated jointly by two related companies (together, “Energine”, “we”):

For data subjects located in Colombia, the controller is Energine Automation S.A.S. For data subjects in Aruba, the Caribbean and the rest of the world, the controller is Davalos Automation Expert Services VBA.

2. What data we collect

• Data you send us through the contact form: name, company, email address, country and the message you write. We only ask for what we need to reply.
• Record of your authorization: date, time, IP address, page and browser from which you accepted, and the version of the documents you accepted. We keep it as proof of your authorization.
• Technical data needed for the site to work securely (IP address, browser type, date and time of the visit), logged by our hosting provider and our security and network provider (Cloudflare).

We do not request sensitive data or data about minors, and we ask you not to include it in your messages.

3. Purposes

• To answer your inquiry, prepare proposals and follow up on your request.
• To keep the site secure, prevent abuse and spam, and fix technical problems.
• To keep proof of your authorization and comply with legal obligations.

We do not sell or rent your personal data, and we do not use it for third-party advertising. If we ever want to use it for a different purpose, we will ask for a new authorization.

4. Authorization

By submitting the form with the authorization box checked, you give your prior, express and informed authorization to process your data for the purposes described. That box is separate from accepting the Terms of Use. We keep a record of each authorization (date, time, IP and version of this policy) that we can make available to you or to the competent authority.

5. Who we share your data with

Only with providers that help us operate, under confidentiality and security obligations (data processors): the website hosting provider, Cloudflare (security and site delivery) and Microsoft 365 (email). We also share it between the two Energine companies to handle your request, or with authorities when required by law.

6. International transfers

Some of these providers store data on servers outside your country, mainly in the United States, and data may move between Aruba and Colombia. By authorizing the processing, you also authorize these transfers, which we only make with providers that offer adequate protection.

7. How long we keep it

We keep contact form messages while there is a business relationship or the possibility of one, and for no longer than 3 years after the last contact. The record of your authorization is kept while we process your data and for any additional period required by law. Technical logs are kept for short periods according to our providers' settings.

8. Security

The site uses an encrypted connection (HTTPS), the authorization record is stored outside the public area of the server, and we apply reasonable technical and organizational measures to protect your data. No system is 100% secure, but we work to reduce the risks.

9. Your rights

As the data subject, you have the right to:

• Access, update and correct your personal data.
• Request proof of the authorization you gave us.
• Be informed of how we have used it.
• Withdraw your authorization and request deletion of your data when there is no legal or contractual duty to keep it.
• Access your data free of charge.
• File complaints with the Superintendencia de Industria y Comercio (SIC) in Colombia, after first completing the inquiry or claim process with us.

10. How to exercise your rights

Write to us with your name, your ID number, a description of your request, the address or email where you want to receive the answer and, if applicable, any supporting documents.

• Inquiries (to know what data we hold): we reply within 10 business days of receipt. If that is not possible, we will tell you why and when we will reply, within no more than 5 additional business days.
• Claims (correction, update, deletion or withdrawal): we reply within 15 business days of receiving the complete claim, extendable by up to 8 business days with notice of the reason. If the claim is incomplete, we will ask you to complete it within 5 days; if 2 months pass without it being completed, we will consider it withdrawn.

11. Cookies and storage

This site does not use advertising or tracking cookies or third-party analytics tools, and fonts are served from our own server. We use one functional cookie (eg_lang) only to remember the language you choose, and our security provider (Cloudflare) may set strictly necessary technical cookies to protect the site. We show the site in Spanish or English based on the country you visit from, without storing your location. If we add analytics or marketing tools in the future, we will update this policy and ask for your consent before enabling them.

12. Effective date and changes

This policy is effective from October 15, 2026. Our databases remain in force while the purposes described are being fulfilled. If we make substantial changes, we will publish the new version on this page with its date and version number.
